A trademark cancellation action is a procedure initiated before a competent intellectual property authority, such as the INPI (French National Institute of Industrial Property) or the WIPO (World Intellectual Property Organization), aimed at depriving the trademark holder of their rights to a trademark. This action is often initiated by a competitor wishing to use the trademark. Cancellation may be granted, in particular, if the trademark has not been used for more than five years or if the trademark has become a generic term through overuse.
