An unfair term is a contractual provision inserted in a contract between a professional and a non-professional that creates a significant imbalance to the detriment of the latter, substantially affecting their respective rights and obligations. Although the law provides an indicative list of such terms, it is primarily case law or the courts that determine whether they are unfair. These terms are often associated with the cancellation conditions of subscription-based services.
