The concept of an olfactory trademark refers to the possibility of registering a distinctive scent as a trademark with an industrial property management organization such as the INPI (French National Institute of Industrial Property). Once considered impossible due to the requirement for graphic representation of trademarks, registering an olfactory trademark is now feasible thanks to the new European Trademark Regulation. This regulation now allows trademarks to be represented in any form using readily available technologies. However, in practice, registering and protecting an olfactory trademark remains complex, requiring a clear, precise, accessible, and enduring description. It is worth noting that some olfactory trademark registrations have been based on samples or chromatographic analyses.
